• Review and provide feedback on deliverables in a timely manner
• Make payments according to the agreed-upon schedule

6. Payment Terms

Payment terms are outlined in the client agreement or statement of work. Unless otherwise specified, invoices are due upon receipt. Late payments may result in work suspension and late fees.

7. Project Timelines

Project timelines are established in the client agreement. Xcellin Creatives will make reasonable efforts to meet agreed deadlines. Delays caused by client factors (such as delayed feedback or content provision) may impact the timeline and are not the responsibility of Xcellin Creatives.

8. Revisions and Alterations

The number of revisions included in a project will be specified in the client agreement. Additional revisions or changes to the project scope may require additional fees and timeline adjustments.

9. Termination

Either party may terminate a service agreement as specified in the client contract. Upon termination, the client is responsible for payment for all services rendered up to the termination date. Xcellin Creatives may terminate services if a client breaches these Terms or the client agreement.

10. Portfolio Rights

Unless otherwise specified in writing, Xcellin Creatives reserves the right to display and link to completed client projects as part of our portfolio and to write about the project for promotional purposes.

11. Limitation of Liability

Xcellin Creatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. In no event shall our liability exceed the amount paid by you for the services in question.

12. Indemnification

You agree to indemnify, defend, and hold harmless Xcellin Creatives, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of our services or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Zambia, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify clients of any significant changes. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
